One of Australia’s longest-serving prime ministers has condemned government plans to recognise a Palestinian state, slamming it as a “betrayal” of international law.

Liberal elder statesman John Howard and his former foreign minister Alexander Downer criticised Labor’s decision, which followed similar moves by allies such as the UK, Canada and France.

“To recognise Palestine prematurely is a betrayal of the legal order that underpins the very idea of a rules-based international system,” the duo said in a joint statement published on Thursday.

Mr Howard and Mr Downer said Palestine did not meet the requirements for statehood as laid out by the Montevideo Convention of 1933.

They also maintained a Palestinian state must emerge from negotiations not unilateral declarations, citing the position of the United Nations Security Council.

If binding resolutions could be brushed aside, then the “authority of international law itself begins to unravel”, the two ex-Liberal leaders said.

Experts have said recognising Palestine is at the discretion of individual states and doing so would not breach any laws or legal obligations.

Almost 63,000 Palestinians have reportedly died in Gaza since October 7, 2023, when Hamas attacked Israel, killing 1200 people and taking more than 200 hostages.

More than 470,000 people in the besieged territory face catastrophic levels of food insecurity as Israel throttles the flow of aid.

A genocide case has been brought against Israel at the International Court of Justice and Israeli Prime Minister Benjamin Netanyahu is facing arrest warrants from the International Criminal Court over his alleged responsibility for war crimes of starvation as a method of warfare.

Israel has dismissed allegations of genocide as being based on a “campaign of lies” and denied widespread starvation in Gaza.

The federal government has condemned Israel’s starvation in Gaza as a “breach of international law”, and will recognise Palestine at the UN later in September.

Thousands of Australian students are pushing for the government to go further in its response, results from a national student referendum published on Thursday revealed.

More than 98 per cent of the 5000 students who participated in the National Union of Students referendum voted in favour of the government sanctioning Israel.

Why anyone with any knowledge of history would pay any attention to the claims of these two men who did so much harm to Australian society, I don’t know. Do they really think that people will believe them?

Howard led us into an illegal war with Iraq, demonised refugees and was involved in the ‘children overboard’ lies. With Downer he led our country into spying onto our tiny impoverished neighbour Timor Leste to get a better deal for for the benefit of the fossil fuel industry. They looked after their own interests and those of their mates at great cost to our international reputation.

To claim that recognising Palestine risks the international rules based order is a joke, as it was broken long ago and is no longer adhered to by some of those who the Liberals claim to be our allies such as the US and Israel. Tens of thousands of innocent children and civilians are being killed by Israel with the US support, both ignoring UN & WHO requests to stop the starvation and killing, even voting against international resolutions to stop the killing.

To focus on Palestine not being ready to be a state is ridiculous, when Israel has done all it can to destroy their leadership and Israel who continually builds illegally on Palestinian land, forcefully removing Palestinians from their homes, farms and businesses.

To claim that there need to be negotiations with Israel for Palestine to claim statehood does not make sense when Israel will not negotiate, instead just dictating their terms with which Palestine must comply for a ceasefire (not the end of the killing which has been going on for decades), while Israel starves the population of Palestinians including babies, children, women, old people, civilians most of whom had nothing to do with Oct 7.

Palestinians have no bargaining power, only Hamas does and their only negotiating power is limited to the hostages that Israel has chosen to abandon, preferring to kill Palestinians and destroy Palestinian society first, even though that causes more hostage deaths. Netanyahu has deserted the principles of a moral society that follows the international rules based order as have those who support his actions. He has discarded local democracy, ignoring his own people and betraying those who rely on his government for support and protection.

Israel has just refused Hamas’s offer to surrender all hostages if Israel will stop the war, saying the war will continue until Hamas agrees to all of Israel’s demands. Clearly the hostages are not important to Netanyahu’s Israel as the offer of their release has been denied so Israel can keep invading, killing and destroying what’s left of Palestine. Israel no longer looks after it’s own people, so why would anyone want to be a citizen of this country?
