A shed construction company has been convicted and fined $70,000 after a worker was injured in a fall at a worksite in Jervis Bay.
Civil Project Management Group Pty Ltd, trading as Real Aussie Sheds, was found guilty in the ACT Magistrates Court of failing to comply with its duties under the Work Health and Safety Act 2011.
Magistrate Lawton fined the company $65,000 for a Category 3 offence and a further $5,000 for failing to ensure high-risk construction work was carried out in accordance with a Safe Work Method Statement.
The convictions relate to a July 2022 incident in which a worker fell from a ladder while helping unload roof sheeting from a crane onto a shed structure during wet and windy conditions.
The court found the company failed to follow its own safety procedures, which required a site risk assessment and work to cease during wet or very windy weather.
It also found safer control measures were available, including scaffolding, elevated work platforms and fall protection systems, but were not used.
Work Health and Safety Commissioner Jacqueline Agius said the case highlighted the risks of continuing work in unsafe conditions.
“Work has proceeded despite unsafe weather conditions, and a worker was injured as a result,” Ms Agius said.
